Internet Provider Cox Communications was held liable for copyright infringements by its users

Facts: In December 2015, a Virginia federal jury ruled that Cox was a contributory copyright infringer because of the infringements that the music licensing company BMG Rights Management suffered as a consequence of Cox’s subscribers behaviour.

Cox renewed its motion for judgment. BMG then asked the court to issue a permanent injunction so that Cox terminated the accounts of pirating users but also prevented further infringements.

The motion for judgement was denied by Judge Liam O’Grady and the first judgement was confirmed. Therefore, the Internet Provider is responsible for all the infringements that happened on its network and it needs to pay $25 million to BMG. However, the permanent injunction was denied to the music licensing company.

Judge O’Grady’s memorandum of opinion is available here (pdf).
